About these Terms

These Terms of Use ("Terms") are a legal agreement between you and Geepers (ABN 15 968 140 556) of New South Wales, Australia ("Geepers", "we", "us", "our"). They govern your access to and use of the Geepers platform, website and apps (the "Platform").

These Terms are written under, and governed by, the law of Australia — in particular the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, and the Privacy Act 1988 (Cth). Where these Terms are read alongside our Privacy Policy, both apply together.

1. Acceptance of these Terms

By creating a Geep, registering an account, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

If you use the Platform on behalf of a business or organisation, you confirm that you are authorised to bind that entity to these Terms, and "you" includes that entity.

2. Eligibility

You must be at least 18 years old to enter into these Terms and create an account. A person aged 16 or 17 may use the Platform only with the consent and supervision of a parent or legal guardian, who accepts these Terms on their behalf.

The Platform is not directed to, and must not be used by, children under 16 years of age. If you believe a child under 16 has provided us with personal information, please contact privacy@geepers.io.

3. What Geepers Is

Geepers is a global naming and addressing system (GNS) that lets users create, share and navigate to named physical locations, events and identities using a unique Geep address.

The Platform depends on the internet, third-party maps and location services, and content created by users. We may add, change, suspend or remove features at any time.

4. Your Account and Geep Identity

You are responsible for keeping your account credentials secure and for all activity under your account. Tell us promptly at support@geepers.io if you suspect unauthorised use.

Your primary Geep is your identity on the Platform. You must choose a name that is your own, a business name you are authorised to use, or a creative identity you legitimately hold. You must not register a Geep that:

  • Impersonates another person, business or organisation
  • Infringes a registered trade mark, business name or other right
  • Is offensive, harmful or misleading
  • Is reserved by Geepers for system or partner use

Acting reasonably, we may reclaim, suspend or rename any Geep that breaches these Terms or infringes another person's rights. Where practicable and lawful, we will give you notice and an opportunity to respond first.

Free Tiers and Commercial Use

Our free tiers — including free personal accounts and free access for genuine non-commercial public benefit ("Social Good") — are for personal, private or non-commercial community use. If you use Geepers commercially — to operate or promote a business, or as an organisation that charges people for the services it provides (including a charity, church, institution or similar that charges for those services) — you need the appropriate paid or commercial plan. Where we reasonably determine that your use is commercial, we may ask you to move to a commercial plan, and our Organisation & API Terms and Billing & Refund Terms will apply.

5. Acceptable Use

You agree not to use Geepers to:

  • Harass, stalk, intimidate, threaten or harm any person
  • Bully, defame, or publish false or misleading information about any person or organisation
  • Distribute spam, malware, phishing content, or any harmful or illegal material
  • Circumvent platform security or access controls
  • Scrape or harvest data from the Platform without our written permission
  • Impersonate any person, organisation or entity
  • Breach any applicable law or regulation in any jurisdiction
Protection of Minors

Geepers takes the safety of persons under 18 years of age extremely seriously. You must not use the Platform to:

  • Contact, solicit or communicate with a minor in any inappropriate, sexual or exploitative manner
  • Share the location, identity or personal information of a minor without the express consent of their parent or legal guardian
  • Use Geep location data to track, monitor or surveil a minor without authorisation
  • Create content that sexualises, endangers, exploits or demeans any minor

Any breach of the above provisions relating to minors will result in immediate account termination and may be reported to relevant law enforcement and child protection authorities without notice.

Geepers will cooperate fully with any lawful law enforcement investigation involving the safety or wellbeing of minors.

Reporting

If you become aware of any use of Geepers that endangers a minor or constitutes harassment, defamation or abuse of any person, please report it immediately to safety@geepers.io. We are committed to investigating all reports promptly and taking appropriate action.

6. Your Content and Licence

Your Geep content — the locations, names, notes, photos and other material you add — remains yours. You are responsible for it and confirm you have the rights to share it.

By posting content on Geepers, you grant us a non-exclusive, royalty-free licence to host, store, reproduce and display that content only as needed to operate, provide and improve the Platform (for example, resolving your Geep for people you share it with). This licence ends when you delete the content or close your account, except for copies retained as required by law or in routine backups for a limited period.

7. Intellectual Property

The Geepers name, logo, platform design and GNS protocol are the intellectual property of Geepers. You may not reproduce, copy or commercially exploit any part of the Platform without our written permission.

8. Third-Party Services, Maps and Location Accuracy

The Platform relies on third-party services, including mapping and navigation providers. Their services are governed by their own terms, and we are not responsible for them.

Location, mapping and navigation information on Geepers is largely user-generated and provided for general convenience. It may be inaccurate, incomplete or out of date, and must not be relied on as a sole source for emergency navigation or any safety-critical decision.

9. Privacy

Our Privacy Policy explains how we handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. It forms part of these Terms.

10. Australian Consumer Law and Consumer Guarantees

Geepers is based in Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) ("ACL").

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or any other law, where to do so would be unlawful. Where our liability for failing to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited — at our option — to re-supplying the relevant services, or paying the cost of having them re-supplied.

11. Limitation of Liability

Subject to section 10 (Australian Consumer Law) and to the maximum extent permitted by law:

  • the Platform is provided "as is" and "as available", without warranties beyond those that cannot be excluded by law;
  • we are not liable for loss of data or Geep records, inability to access the Platform, or reliance on location or navigation information; and
  • we are not liable for any indirect, incidental, special or consequential loss, or loss of profits, revenue or goodwill.

To the extent our liability can lawfully be limited (and is not governed by section 10), our total liability to you for all claims connected with the Platform is limited to AUD $100, or the amount you paid us for the service in the 12 months before the claim, whichever is greater.

12. Indemnity

To the extent permitted by law, you agree to indemnify us against loss, damage or reasonable costs we suffer arising from your breach of these Terms or your unlawful use of the Platform, except to the extent the loss was caused by us.

13. Suspension and Termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you materially or repeatedly breach these Terms, or where required to protect users, the public or Geepers. Where practicable and lawful, we will give you notice and a chance to fix the issue. Sections that by their nature should survive termination (including sections 6, 7, 10, 11 and 12) will continue to apply.

14. Geep Lifecycle

Geeps that are inactive for 12 months will receive a renewal prompt by email. If no response is received within 90 days, the Geep may be archived and the name may be made available for re-registration.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here and, for material changes, notify registered users by email or in-app. Continued use of the Platform after changes take effect means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. Nothing in this section limits any right you have to bring proceedings, or rely on protections, that cannot be excluded under Australian law.

17. Dispute Resolution

If you have a concern, please contact us first at legal@geepers.io so we can try to resolve it. If we cannot resolve it within a reasonable time, either of us may pursue the matter through the courts. This does not affect your right to make a complaint to a regulator, or to seek an urgent remedy from a court.
